Terms of use

General terms governing use of margemx.com and the services presented, under Portuguese law (Decree-Law 7/2004 and the Civil Code).

Provider. The site margemx.com is operated by Luís Miguel Pires, sole trader (Empresário em Nome Individual / ENI), Portuguese tax number (NIF) 259 580 007, professional address in Viana do Castelo, Portugal, contact geral@margemx.com. MargemX is a commercial brand under which consulting, automation, applied AI, software development and digital systems services are provided.

Scope. The site presents commercial information about services. Examples, metrics and case studies may omit details under confidentiality agreements. Nothing on the site constitutes binding technical, tax or legal advice.

Free diagnostic. The free initial diagnostic is not a binding commercial proposal. Any engagement is formalised by a written contract or quote signed by both parties, with its own scope, timeline, price and conditions.

Payments. Prices are agreed in writing on a case-by-case basis. Unless otherwise stated, payments are made by bank transfer plus VAT at the legal rate. Late payment triggers statutory interest under the Portuguese Commercial Code.

User obligations. Users undertake to use the site lawfully, to provide accurate information in forms, not to submit third-party personal data without legal basis, not to submit special-category data through unencrypted channels, and not to attempt to compromise the security of the site.

Intellectual property. Texts, images, marks, visual identity and code are protected by Portuguese copyright and industrial property laws. Reproduction, distribution, modification or commercial use without prior written authorisation is prohibited. Project deliverables are governed by the specific contract.

Liability. Save in cases of wilful misconduct or gross negligence, and within the limits allowed by law, the provider's liability for the informational content of the site is limited. The site is provided as-is with no warranty of uninterrupted availability or fitness for a particular purpose.

Artificial intelligence. AI systems used in contracted services comply with Regulation (EU) 2024/1689 (EU AI Act) and applicable sectoral rules. Automated decisions with significant impact on the client's end users are documented contractually and subject to adequate safeguards.

Data protection. Personal data processing is governed by the Privacy policy at margemx.com/privacidade, which forms an integral part of these terms.

Complaints and ADR. Consumer users may file a complaint at the Portuguese Electronic Complaints Book (www.livroreclamacoes.pt). For out-of-court resolution of consumer disputes, the Portuguese arbitration body CNIACC is available (www.cniacc.pt), as is the European ODR platform (ec.europa.eu/consumers/odr).

Governing law and jurisdiction. These terms are governed by Portuguese law. The court of the District of Viana do Castelo has exclusive jurisdiction, without prejudice to mandatory consumer-protection rules granting more favourable forum.

Changes. The provider may amend these terms at any time. The version in force is the one published on this page; the version in force at the date of contract signature applies to ongoing engagements unless otherwise agreed.
